General terms of use of AUTOMIUM.BE

Article 1: Purpose

 

These Terms and Conditions or General Conditions of Use legally frame the use of the services of the AUTOMIUM site (hereinafter referred to as “the site”).

 

Constituting the contract between the company AUTOMIUM, the User, access to the site must be preceded by the acceptance of these TOU. Access to this platform means acceptance of these TOS.

 

Article 2: Legal notice

 

The AUTOMIUM.BE site is published by MOTOR RACING TILMAN, registered with the ECB under the number BE 0416.154.744, whose registered office is located at Rue Cour au Bois(W-B) 6f. 1440 Braine-le-Château, Belgium

 

The host of the automium.be website is the company ONE.COM, located at Carlsgatan 3 211 20 Malmö Swede

 

Article 3: Access to the site

 

The site is accessible free of charge from anywhere by any user with Internet access. All costs necessary for access to the services (computer equipment, Internet connection, etc.) are at the user’s expense.

 

Access to the services dedicated to members is by means of a login and a password.

 

For maintenance or other reasons, access to the site may be interrupted or suspended by the publisher without notice or justification.

 

Article 4: Data collection

 

For the creation of the User’s account, the collection of information at the time of registration on the site is necessary and mandatory. The trademarks, logos and contents of the AUTOMIUM website (graphic illustrations, texts…) are protected by the Intellectual Property Code and by copyright.

Reproduction and copying of the contents by the User requires prior authorisation from the site. In this case, any use for commercial or advertising purposes is prohibited.

Article 6: Liability

Although the information published on the site is deemed reliable, the site reserves the right not to guarantee the reliability of sources.

The information published on the AUTOMIUM website is presented for information purposes only and has no contractual value. Despite regular updates, the site cannot be held responsible for any changes in administrative and legal provisions that occur after publication. The same applies to the use and interpretation of the information provided on the platform.

The site declines all responsibility for any viruses that may infect the user’s computer equipment after using or accessing this site.

The site cannot be held responsible in the event of force majeure or the unforeseeable and insurmountable act of a third party.

Article 9 : Publication by the User

The AUTOMIUM site allows members to publish comments.

In his publications, the member is required to respect the rules of Netiquette as well as the legal rules in force.

The member retains all intellectual property rights. However, any publication on the site implies the delegation of the non-exclusive and free right to the publishing company to represent, reproduce, modify, adapt, distribute and disseminate the publication anywhere and on any medium for the duration of the intellectual property. This may be done directly or through an authorised third party. This includes the right to use the publication on the web and on mobile phone networks.

The publisher undertakes to mention the name of the member in the vicinity of the publication for each use.

The User is responsible for any content that he/she puts online. The User undertakes not to publish content that may harm the interests of third parties. Any legal proceedings brought by an injured third party against the site shall be borne by the User.

The deletion or modification by the site of the User’s content may be carried out at any time, for any reason and without notice.

Article 11: Duration of the contract

This contract is valid for an indefinite period. The beginning of the use of the services of the site marks the application of the contract with regard to the User.

Article 12: Applicable law and competent jurisdiction

This contract is subject to Belgian law. If no amicable solution is found to a dispute between the parties, the Belgian courts shall have jurisdiction to settle the dispute.
